Donald J. Trump for President, Inc. v. Benson (State Court)

20-000225-MZ | Closed

The Trump Campaign filed suit against Secretary of State Jocelyn Benson for an emergency injunction to stop processing and counting absentee ballots until an election inspector from each party was able to observe the process, as required by Michigan law. The campaign also asked that ballots that had not been inspected but were processed be segregated.

Judge Stephens denied the suit, saying it had been filed hours before the end of the vote counting on November 4 and because Secretary Benson was not the right Defendant. However, Secretary Benson was named in the federal suit that the Trump Campaign filed on November 11 in US District Court (No. 1:20-cv-01083 (W.D. Mich.).
